These Terms of Service ("Terms") apply to your use of whiskersagenda.com (the "Site") and any purchase you make from Whiskers Agenda. The Site is operated by OmniRetail LLC, a Wyoming limited liability company, 30 N Gould St, Ste R, Sheridan, WY 82801, United States ("Whiskers Agenda," "we," "us," or "our"). By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.
1. Eligibility and your account
You must be at least 18 years old, or the age of majority where you live, to place an order. You agree to give accurate, current and complete information when you check out or create an account, and you are responsible for keeping your login details secure.
2. Products and descriptions
We try to describe and photograph our products as accurately as possible, including sizes and colors. Colors may look slightly different depending on your screen, and measurements are approximate. If a product isn't as described, your remedy is set out in our Refund Policy.
We may change, limit or discontinue products at any time. Quantities may be limited.
3. Pet safety and product use
Every pet is different, and you know yours best. Please read and follow the product description and any included instructions before use. In particular:
- Always supervise your pet when using enrichment toys, lick mats, snuffle toys, scratch mats and similar products.
- Our products are not chew toys unless stated otherwise. Check them regularly for wear and damage, and remove and replace any item that is torn, chewed or broken, to avoid choking or swallowing hazards.
- Choose the right size for your pet, and use only food and treats that are safe for your pet.
- Our products are not medical or veterinary devices. They are not intended to diagnose, treat, cure or prevent any condition, and they are not a substitute for professional veterinary advice. If you have concerns about your pet's health or behavior, please talk to your veterinarian.
To the extent permitted by law, we are not responsible for injury, illness or damage resulting from use of a product in a way that is unsupervised, not in line with its instructions or intended purpose, or after it has become worn or damaged.
4. Prices and payment
All prices are listed in US dollars (USD) unless shown otherwise at checkout. If you pay in another currency, your bank or card issuer may apply its own exchange rate or fees. We accept major credit and debit cards and other payment methods shown at checkout. Applicable taxes, and shipping charges for orders outside the US, are shown at checkout before you pay.
We reserve the right to correct pricing or description errors. If an error affects your order, we'll contact you and give you the option to continue at the correct price or cancel for a full refund.
5. Orders
Your order is an offer to buy. We accept your order when we ship it. We may refuse or cancel an order (for example, if a product is unavailable, there is a pricing error, or we suspect fraud). If we cancel an order after you've paid, we'll refund you in full.
You can cancel your order free of charge before it ships by emailing support@whiskersagenda.com. After it ships, our Refund Policy applies.
6. Shipping, returns and refunds
Shipping is covered by our Shipping Policy, and returns and refunds by our Refund Policy. Both form part of these Terms.
7. Intellectual property
The Site and its content, including the Whiskers Agenda name and logo, our mascots, text, photos, videos and graphics, are owned by or licensed to OmniRetail LLC and protected by intellectual property laws. You may view and share our pages for personal, non-commercial use. You may not copy, reproduce, sell or use our content for commercial purposes without our written permission.
8. Reviews, comments and submissions
If you send us or post reviews, photos, comments or ideas, you confirm they are your own, are accurate, and don't violate anyone's rights or any law. You give us a non-exclusive, royalty-free right to use, reproduce and display them in connection with the Site and our marketing. We may remove any content at our discretion. We don't pay for submissions unless agreed in writing.
9. Acceptable use
You agree not to misuse the Site, including by attempting to interfere with its operation or security, using it for any unlawful purpose, placing fraudulent orders, scraping content, or reselling our products without our permission.
10. Third-party services
The Site runs on BigCommerce and uses other third-party services (such as payment processors and shipping carriers). We are not responsible for third-party websites or services we don't control, and their own terms and privacy policies apply.
11. Disclaimer of warranties
Except as expressly stated in these Terms and our policies, and to the fullest extent permitted by law, the Site and products are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that the Site will be uninterrupted or error-free. Nothing in these Terms affects any rights you have under consumer protection laws that cannot be waived or limited.
12. Limitation of liability
To the fullest extent permitted by law, OmniRetail LLC and its members, managers, employees and service providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from your use of the Site or any product. Our total liability for any claim relating to the Site or a product is limited to the amount you paid for the product that gave rise to the claim.
Some jurisdictions don't allow certain exclusions or limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
13. Indemnity
You agree to indemnify and hold harmless OmniRetail LLC from any claims, losses or expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Site or our products, to the extent permitted by law.
14. Dispute resolution
If you have a problem, please contact us first at support@whiskersagenda.com. Most issues can be solved quickly by email. If we can't resolve a dispute informally within 30 days of your first message, either of us may pursue it in the state or federal courts located in Wyoming, and you and we consent to the jurisdiction of those courts. Either of us may instead bring an individual claim in small claims court where it qualifies. If you live outside the United States, you may also have the right to bring a claim in the courts of your country of residence under mandatory local consumer law.
15. Governing law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. If you are a consumer living outside the US, you also keep the protection of any mandatory consumer laws of your country of residence.
16. Changes to these Terms
We may update these Terms from time to time by posting a new version on this page and changing the "Last updated" date. The version in effect when you place an order applies to that order.
17. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. These Terms, together with our Shipping, Refund and Privacy Policies, are the entire agreement between you and us about the Site and your purchases. We may transfer our rights and obligations under these Terms to a successor business.
